Order at The O2 Terms and Conditions

TERMS OF USE

1.      GENERAL

1.1. These terms and conditions ( "Terms") govern the use of the The O2's Food and Beverage app, also called  Order at The O2 ( "app") provided by Accumulate AB on behalf of  Ansco Arena Ltd, The O2, London SE10 0DX (“AEG”) for use by customers at The O2 arena  ("The O2").

1.2. By downloading or using the app, these Terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app.

1.3.  By creating an account and using the app you agree and accept the Terms and agree that your personal data is processed in accordance with The O2's privacy policy ("Privacy Policy") http://www.theo2.co.uk/legal/privacy which is an integral part of these Terms.

1.4. In order to make purchases inside the app, you must be at least 18 years and / or otherwise authorized to enter into agreements and accept to be bound by the Terms and any other terms and conditions provided by The O2's partners from time to time.

1.5. All food and beverages are provided by a third party, Levy Restaurants, and not The O2/AEG. Food and beverage offers are subject to Levy Restaurants terms and conditions.

1.6. Use of the app is free. Traffic charges to your carrier or Internet service provider may apply. Through the app, you have the opportunity to take advantage of specific services (including food and beverage ordering from your seat within The O2 arena) and other offers from The O2 and their partners, some of which may require payment. You will in such cases be informed in advance.

1.7. These Terms, its subject matter and its formation, are governed by English law and the courts of England and Wales will have non-exclusive jurisdiction.

2.      ACCOUNT REGISTRATION

2.1. You have the ability to create a personal account to enable the use of the app's features. Furthermore, you have the option to register your card and bank statements or other information that is necessary to make purchases inside the app.

2.2.  Unless otherwise specified in the service-specific terms you must register one or more debit cards, credit cards, or other valid payment cards in order to benefit from the ordering service by entering your card information in the app (for debit cards given card number, cardholder name, expiration date and CVV code; and for cards other than debit cards, only the card number). You can also scan the card using the camera feature in the phone. You must then manually enter any other required information, such as the CVV code and expiration date.

2.3.  All user information and payment is secured by Accumulate Close Payment Gateway. The card number is sent through a strongly encrypted connection directly to the bank. No information about your card or bank account information is stored in the app. Accumulate follow the requirements of industry standard Payment Card Industry Data Security Standard (PCI DSS).

3.      ORDERING AND COLLECTION

3.1. Only those customers who have gained entry or are about to gain entry to The O2 blueroom bar on Level 1 of The O2 arena concourse can order through the Order at The O2 app. The order menu will be open 30 minutes before the bar opens.

3.2. Collection of food and beverage orders is only in The O2 blueroom bar unless otherwise promoted within the app. 

3.3. You must be 18+ to purchase alcohol. Certain offers are age restricted and will require proof of age or identification. A Think 25 policy is operated by Levy Restaurants and purchase requires proof of ID. Please check return policies with Levy Restaurants. 

3.4. Use of the app does not guarantee you entry to The O2 blueroom bar or any other areas of restricted access. 

3.5. For any issues with use of the app, please speak to an O2 Angel on the night of the event. You must be a holder of a valid ticket for tonight's show to gain access to The O2 blueroom bar or any other space within The O2 arena. Space is limited so there will be no entry once the bar has reached full capacity. For more information please speak to an O2 Angel.

4.      APP FUNCTIONALITY AND YOUR DATA

4.1. In some cases push notifications, sms and/or inbox are required for the app functionality. The information you provide via the app and/or any information which is collected by the app may include your personal data which is processed in accordance with the Privacy Policy. By using the app you consent to The O2 and its partners (including Levy Restaurants) collecting, processing, retaining, maintaining and/or using such data in accordance with the terms of the Privacy Policy (and/or the relevant partner’s privacy policies) as applicable.

4.2. The O2 and its partners may send you information and offers through the app, or via email, SMS or other means where you have consented to receive such offers and information. All such communication will comply with applicable laws, codes of conduct and ethical guidelines. Through the use of the app, you automatically agree to receive communications from The O2 and its partners. If you no longer wish to receive such communications and offers, you can unsubscribe according to information contained in each marketing message (and/or as further described in the Privacy Policy).

4.3.  In addition to food and beverage ordering The O2 and its partners may also offer you additional services and features in the app. Such services and features may be subject to special conditions, which will be notified to you at the relevant time. If you want to activate or use such services or functions the user may be required to approve the special conditions that apply to the specific service or feature. The O2 is not responsible for the functions and services provided by The O2's partners or via third party links/sites. The app can also contain links to or offers from external partners who have other conditions than The O2. Users are encouraged to become familiar with these terms.

5.      OTHER

5.1. The copyright in all material contained on, in, or available through the app including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations and other material (“Material“), together with all trademarks displayed within the app, are owned by or licensed to AEG or its group companies. All rights are reserved. You may not copy or otherwise use such Material or trademarks without prior express consent of AEG.

5.2. At some point we may wish to update the app. The app is currently available on Android and iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. We do not guarantee that any updates will work on your device.

5.3. The O2 reserves the right to suspend or cease providing any services relating to the apps published by it, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if it chooses to do so.

5.4. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; and (b) you must stop using the app, and (if needed) delete it from your device.

5.5. The app is used at your own risk. To the fullest extent permitted by law, AEG/The O2 excludes all liability in respect of the app and your use of the app. Your statutory rights are not affected.
